PAIA Manual

This manual is published in terms of Section 51 of the Promotion of Access to Information Act, 2000 (Act No. 2 of 2000) (“the Act”). The Act gives effect to the provisions of Section 32 of the Constitution, which provides for the right of access to information held by the State and to information held by another person that is required for the exercise or protection of any right.

3. Guide on how to use the Act

4. Records Available in Accordance with other Legislation

We hold records in accordance with all legislation that is applicable to our business, which may include, but is not limited to:

  • Companies Act, 71 of 2008
  • Income Tax Act, 58 of 1962
  • Value Added Tax Act, 89 of 1991
  • Basic Conditions of Employment Act, 75 of 1997
  • Electronic Communications and Transactions Act, 25 of 2002
  • Protection of Personal Information Act, 4 of 2013

5. Categories of Records Held

We maintain records in the following categories:

  • Company Records: Documents of incorporation, memorandum of incorporation, minutes of board meetings, records relating to the appointment of directors, etc.
  • Financial Records: Annual financial statements, tax records, asset register, banking records, invoices.
  • Client-related Records: Records provided by a client, records generated by us or on behalf of a client, transactional records.
  • Personnel Records: Employment contracts, employee details, leave records, salary records, disciplinary records.
  • Policies and Procedures: Internal policies and procedures.

6. The Request Procedures

To request access to a record, the requester must complete the prescribed form (Form C), available on the SAHRC website. The completed form must be submitted to the Information Officer at the contact details provided above. The requester must provide sufficient details to enable the company to identify the record and the requester. The requester must also indicate which form of access is required and specify a postal address or fax number in the Republic.

This manual is available for inspection at our office, on our website, and from the South African Human Rights Commission.
